I see where you got the copyright message from. Its from http://www.artnet.de/artwork/424645113/159979/roger-fry-portrait-of-edith-sitwel... , the site which Wikipedia got the image from. Since the photograph is a straight reproduction of a public domain work, Wikipedia argues that it cannot be copyrighted:
http://commons.wikimedia.org/wiki/Commons:When_to_use_the_PD-Art_tag . If this page is correct, then the legal precent seems fairly solid (though I Am Not A Lawyer, etc, etc).

I am not certain why you are seeing that copyright message. I cannot see it anywhere myself

If you go to http://commons.wikimedia.org/wiki/File:Portrait_of_Edith_Sitwell.jpg you will see that under the copyright information it says:

"This image (or other media file) is in the public domain because its copyright has expired.
"This applies to the United States, Australia, the European Union and those countries with a copyright term of life of the author plus 70 years."

From my reading of the picture guidelines, images which are in the public domain are okay. If I am mistaken on this and public domain images are *not* okay, then I (or somebody else) should delete it.
