As part of its preparation of its report on feudal abolition, the Scottish Law Commission came to realise that the whole law of real burdens was in need of fundamental reform. A real burden is an obligation affecting land or buildings. It usually either restricts the way in which the property can be used, or imposes an affirmative obligation on its owner. Strictly speaking, as it is constituted in property law, the real burden is unique to Scotland. This report represents the outcome of the Commission's thorough consultation and investigation process. The Commission's recommendation is that significant reform of this aspect of Scottish property law is required. The appendices contain draft legislation as drawn up by the Commission.
