Modern systems theory provides a new paradigm for the analysis of society. Warning: May contain spoilers.)Può comunque dirsi, a conclusione di questa analisi introduttiva, che se l'approccio di Luhmann non è, come pretende di essere, la via maestra, esso non è neppure un vicolo cieco. In particolare, il lavoro che qui si presenta, nonostante i limiti teorici e metodologici che si sono già visti, si propone come un insostituibile punto di riferimento per chi voglia tentare di discutere i problemi della sociologia del diritto a livello macroteorico e suggerisce, attarverso il suo approccio funzionalistico, un modo estremamente fruttuoso di sviluppare la vocazione demistificatrice che la sociologia del diritto, come ogni sociologia, porta con sé.

Da ciò si può ricavare, a voler fare i moralisti, la inanità degli sforzi compiuti finora. Un teoria sociologica del diritto, invece, riconoscerà in questa situazione un problema secolare che può giungere a una soluzione più stabilizzabile nella misura in cui, nella stessa vita giuridica, gli uomini apprendono a comportarsi, anche nei confronti del diritto, in modo suscettibile di apprendimento.
