Mike Bloomberg raises $16 million to allow former felons to vote in Florida

Former New York mayor Mike Bloomberg and his team have raised more than $16 million to pay the court fines and fees of nearly 32,000 Black and Hispanic Florida voters with felony convictions, an effort aimed at boosting turnout for Democratic presidential candidate Joe Biden.
The money will go to fund a program organized by the Florida Rights Restoration Coalition to pay the fines, fees and restitution costs for former prisoners who are already registered to vote in Florida but barred by law from participating in the election because of those outstanding debts.
Bloomberg, who has committed at least $100 million to electing Biden in the state, raised the money from individuals and foundations over the past week, his advisers said. He saw the donations as a more cost-effective way of adding votes to the Democratic column than investing money to persuade voters who already have the right to vote, a Bloomberg memo said.
..The Florida Rights Restoration Coalition is a nonpartisan group that has been fundraising to return all former felons in the state to the voting rolls. Desmond Meade, the group’s president, said the group does not share Bloomberg’s goal of empowering only one political side in the upcoming election.
He said that through separate efforts, his organization has raised about $7 million from about 44,000 donors to help pay the debts of citizens with felony convictions so they can return to the voting rolls. The average debt, the group said, is about $1,000.
After organizing by Meade’s group, Florida voters passed a statewide constitutional amendment in 2018 that gave former felons, except those convicted of murder or felony sexual offenses, the opportunity to vote in upcoming elections. The Republican-controlled legislature subsequently passed, and the Republican governor signed, a law that conditioned their return to the voting rolls on the payment of all fees, fines and restitution that were part of their sentence.
Subsequent court challenges upheld the power of the legislature to condition voting rights on the payment of debts by former felons. Judge Barbara Lagoa, who is under consideration by President Trump as a possible replacement for Supreme Court justice Ruth Bader Ginsburg, cast a concurring opinion on the 11th Circuit Court of Appeals upholding the state law requiring payment of debts.
The Republican effort is expected to limit what some viewed as a political benefit to Democrats of the constitutional change, which passed by ballot initiative with 65 percent support. A study by the University of Florida found that nearly 775,000 former felons still owed money related to their convictions and would be barred from the voting booth by the law. The vast majority are too poor to pay their outstanding debts, according to evidence presented in court documents challenging the law.
Several philanthropic groups, including a nonprofit founded by the professional basketball player LeBron James, have since committed donations to pay the owed money. The Bloomberg effort, which his aides said will be pooled with about $5 million already raised by the Florida Rights Restoration Coalition, is narrowly focused only on Black and Hispanic voters who are already registered to vote and whose debts are less than $1,500.
..Bloomberg aides said the former New York mayor, who is worth more than $50 billion, had raised the money for this effort from others and that the sum would not count against the $100 million or more he has personally committed to spend on behalf of Biden in the state.
The Bloomberg memo pointed out that the 31,790 targeted voters, including 25,548 who are Black, are nearly equivalent to the margin by which Gov. Ron DeSantis (R) won election in 2018, and about three times as big as the margin that elected Sen. Rick Scott (R-Fla.) that same year.

Abstract

Phase I/II trial data is already available for several vaccine candidates and many have moved into Phase III trials. ...The experimental vaccine being developed by pharmaceutical giant Johnson & Johnson is the fourth vaccine to enter the large, Phase 3 trials in the United States that will determine whether they are effective and safe. Paul Stoffels, chief scientific officer of J&J, predicted that there may be enough data to have results by the end of the year and said the company plans to manufacture 1 billion doses next year.
...The company is initially testing a single dose, whereas the other vaccines being tested in the United States require a return visit and second shot three to four weeks after the first one to trigger a protective immune response. The J&J vaccine can also be stored in liquid form at refrigerator temperatures for three months, whereas two of the front-runner candidates must be frozen or kept at ultracold temperatures for long-term storage.
The United States has invested...close to $1.5 billion to support the development of the J&J vaccine and an advance purchase of 100 million doses. The J&J vaccine is the second to use a viral-vector approach, taking a harmless virus and inserting into it a gene that contains the blueprint for a distinctive part of the novel coronavirus.

“I'm being facetious. I said, what country are we in? Look, he says the most irrational things. I don't know what to say,” Biden added, according to a pool report.
During a White House briefing, Trump refused to commit to a peaceful transition of power should he lose the November election, instead once again sowing doubt about the security of mail-in ballots.
“We’re going to have to see what happens, you know, but I’ve been complaining very strongly about the ballots. The ballots are a disaster,” Trump said when asked if he would commit to making sure there is a peaceful transition of power.
Pressed on the question, Trump said there would be no need for a transition of power without mail-in ballots.
“Get rid of the ballots and you’ll have a very peaceful — there won't be a transfer, frankly. There will be a continuation,” Trump said. “The ballots are out of control. You know it, and you know who knows it better than anyone else? The Democrats know it better than anyone else.”
The president has repeatedly made unsubstantiated claims that mail-in ballots lead to mass voter fraud, despite experts saying there is no evidence of meaningful fraud in vote by mail.
Trump’s comments were publicly questioned by at least one member of his own party Wednesday night. Sen. Mitt Romney (R-Utah) tweeted that the peaceful transition of power is “fundamental to democracy” without directly addressing Trump...

Following the casting of ballots and counting individual votes in a presidential election, the United States Constitution prescribes that the 538 electors who constitute the Electoral College cast their electoral votes, determining the winner.
Customarily, electors are chosen by popular vote, but nothing in the Constitution mandates that tradition, with Article II, Section 1, Clause 2 merely asserting that each state shall appoint electors “in such Manner as the Legislature thereof may direct.”
Since the late 1800s, every state in every presidential election has ceded the decision to its voters, but the Supreme Court affirmed in Bush v. Gore that a state “can take back the power to appoint electors.”
The Atlantic report claims that sources in the Republican Party at the local and national levels confirm that “the Trump campaign is discussing contingency plans to bypass election results and appoint loyal electors” in red battleground states.
“The push to appoint electors would be framed in terms of protecting the people’s will,” an unnamed Trump-campaign legal adviser tells The Atlantic, adding, “The state legislatures will say, ‘All right, we’ve been given this constitutional power. We don’t think the results of our own state are accurate, so here’s our slate of electors that we think properly reflect the results of our state.’”
The chairman of the Pennsylvania Republican Party says, on the record, that he has discussed appointing loyal electors with the Trump campaign: “It is one of the available legal options set forth in the Constitution.”...

He promised to create jobs for instance---what he's really created is joblessness. MADISON, Wis. (AP) — A federal appeals court on Tuesday upheld a six-day extension for counting absentee ballots in Wisconsin’s presidential election, handing Democrats a victory in their fight to deliver the key battleground state for Joe Biden in November.
The decision, if it stands, means that ballots postmarked on or before Nov. 3 will be counted as long as they are received by Nov. 9. That could mean the winner in Wisconsin won’t be known for days after the polls close. Republicans could appeal the case to the U.S. Supreme Court.

#50--my wife went to visit her 88 year old mother today in Sunderlinville Pa which is this tiny place in Potter County. There is a history of white supremacist nutjobs in that county. For instance traveling south from there you would run into the town of Ulysses which has a Nazi house as you enter town with all these Nazi flags festooning the house and statues sitting right out in the yard and it's been passed along from one child molesting knucklehead to another about 4 or 5 times now and they're all Aryan nations idiots. Anyway going up to her mom's house all my wife saw along the way was Trump signs everywhere until she reached her mom's house which had the only Biden sign probably for miles.
Going home later on she stops at a dollar store in Westfield. There's 8 or 9 people in the place but the only one wearing a mask was the store clerk so my wife just walked right out.

If the republicans manage to kill that program--the democrats shouldn't bother to revive it--as soon as they have the majority (and it won't be long) the Democrats should go straight to Medicare for All. It's been obvious hasn't it that ever since the ACA came into being the republican party has been working tooth and nail to undermine it---they're going to continue that project forever and ever. If you revive the ACA after they kill it it will be more of the same. The thing with a medicare for all program is once it's established it becomes almost immediately off limits---conservatives all over the world don't even think of touching those programs because in fairly quick time they're too popular with their own base.

Much was made about how late in the game-(July 15) to be replacing your campaign manager but now even he might need replacement. A sick president and his sick campaign manager with one month to go. ...The United States came into this crisis with enormous advantages. Along with tremendous manufacturing capacity, we have a biomedical research system that is the envy of the world. We have enormous expertise in public health, health policy, and basic biology and have consistently been able to turn that expertise into new therapies and preventive measures. And much of that national expertise resides in government institutions. Yet our leaders have largely chosen to ignore and even denigrate experts.
The response of our nation’s leaders has been consistently inadequate. The federal government has largely abandoned disease control to the states. Governors have varied in their responses, not so much by party as by competence. But whatever their competence, governors do not have the tools that Washington controls. Instead of using those tools, the federal government has undermined them. The Centers for Disease Control and Prevention, which was the world’s leading disease response organization, has been eviscerated and has suffered dramatic testing and policy failures. The National Institutes of Health have played a key role in vaccine development but have been excluded from much crucial government decision making. And the Food and Drug Administration has been shamefully politicized,... appearing to respond to pressure from the administration rather than scientific evidence. Our current leaders have undercut trust in science and in government,... causing damage that will certainly outlast them. Instead of relying on expertise, the administration has turned to uninformed “opinion leaders” and charlatans who obscure the truth and facilitate the promulgation of outright lies.
Let’s be clear about the cost of not taking even simple measures. An outbreak that has disproportionately affected communities of color has exacerbated the tensions associated with inequality. Many of our children are missing school at critical times in their social and intellectual development. The hard work of health care professionals, who have put their lives on the line, has not been used wisely. Our current leadership takes pride in the economy, but while most of the world has opened up to some extent, the United States still suffers from disease rates that have prevented many businesses from reopening, with a resultant loss of hundreds of billions of dollars and millions of jobs. And more than 200,000 Americans have died. Some deaths from Covid-19 were unavoidable. But, although it is impossible to project the precise number of additional American lives lost because of weak and inappropriate government policies, it is at least in the tens of thousands in a pandemic that has already killed more Americans than any conflict since World War II.
Anyone else who recklessly squandered lives and money in this way would be suffering legal consequences. Our leaders have largely claimed immunity for their actions. But this election gives us the power to render judgment. Reasonable people will certainly disagree about the many political positions taken by candidates. But truth is neither liberal nor conservative. When it comes to the response to the largest public health crisis of our time, our current political leaders have demonstrated that they are dangerously incompetent. We should not abet them and enable the deaths of thousands more Americans by allowing them to keep their jobs.

What Does a Good Election Outcome Look Like (or: Do Republican-Appointed Justices Have Any Shame)?

...In a new Verdict column today,* I explain what I think people like Dorf, Tribe, and many other scholars are doing in laying out analyses of why, for example, Republican-led state legislatures cannot simply declare their states' voting outcomes to be invalid as an excuse to send Trumpists to the Electoral College. Essentially, they -- we -- are saying that this happens to be an area of law in which there is no wiggle room. Constitutional provisions, statutes, and decades of precedent simply do not support anything like what Republicans are now openly discussing in terms of anti-democratic gambits.
...So what is the best-case scenario in which Trump screams that his loss in the election was all a scam but still ends up leaving office? It took me awhile to acknowledge that the degree of Trump's defeat mattered, because I have always assumed that Trump was going to make the same crazy claims no matter what happens. But the larger are the victories in the various states, the more difficult it becomes for any particular Republican to say that it was all fake.
...Which means that there will almost certainly be moments when the Supreme Court will be called upon to rule. In most instances, it will be better for the Court to refuse the invitation, so even a decision to take some cases will be evidence that something bad is about to happen. But even then, five justices on the Supreme Court will have to bless an utterly lawless breaking of the system. I suspect that at least two of the Republican-appointed justices are all in on anything, and (even leaving out the new person who is likely to have been installed by then) there is every reason to worry about the other Republican-appointed justices.
Remember also that those justices are not going to be ruling in a vacuum. There will likely be large protests in the streets, which will have become violent at Trump's instigation. The justices will also have to worry about whether it even matters that they could be destroying their own legitimacy in the service of a man who is not even a movement conservative (or a conservative of any kind, other than the racism).
And these jurists are human beings with personal histories, friends, and professional relationships that are all tied to the Republican Party. In the biggest moment of their lives, will they be willing to say that everyone who talks to them is going to have to accept that the law is simply not on their side? Or will they instead shed the last remnants of shame and say that we have always been at war with Eastasia, that freedom is slavery, and all the rest?
What does a "good outcome" look like, in a not-at-all-good world in which Trump will do everything to destroy the system for his own benefit? Either enough state-level Republicans will stand down on the claims of mail-in voter fraud and do what is right without needing to go to court, or the Supreme Court will (passively, one hopes, but possibly actively) tell them that some legal arguments are simply too outlandish to take seriously. Am I confident? No. Am I hopeful? Always, and all the more so as the legal case is made that none of Trump's ploys passes the laugh test.

“Operating unofficial ballot drop boxes – especially those misrepresented as official drop boxes – is not just misleading to voters, it’s a violation of state law,” Padilla said, with a felony conviction carrying a prison sentence of two to four years.
...The California Republican Party did not respond to requests for comment about the boxes by deadline. But they’ve been defending the practice in replies on Twitter, alleging the process was made legal under a 2016 law that allows California voters to designate a person to return their ballot for them. Voters have cast a total of 17,709,396 ballots in the reporting states. Greatest number returned in FL, followed by CA, then TX. The big states are turning out, two of them are red-to-blue possibilities and high voter turnout is NOT good for Republicans. Second tier leaders are MI, VA, and NJ. Postal Service agrees to reverse service changes

...The lawsuit filed against Postmaster General Louis DeJoy and the U.S. Postal Service on Sept. 9 argued changes implemented in June harmed access to mail services in Montana, resulting in delayed delivery of medical prescriptions, payments, and job applications, and impeding the ability...to vote by mail.
The postal service agreed to reverse all changes, which included reduced retail hours, removal of collection boxes and mail sorting machines, closure or consolidation of mail processing facilities, restriction of late or extra trips for timely mail delivery, and banning or restricting overtime.
The agreement also requires the Postal Service to prioritize election mail.
The settlement agreement was reached a day ahead of a hearing in the U.S. District Court in Great Falls. It applies to all states.
Judge Stanley Bastian in Yakima, Washington, issued the nationwide preliminary injunction sought by 14 states that brought forward a separate suit against the Trump administration and the U.S. Postal Service. The 14 states, led by Democratic attorneys general, expressed concern that delays might result in voters not receiving ballots or registration forms in time.

Which has almost everything to do with Biden raising over $300 in the last month, especially receiving around two thirds of that in the post-debate response of "little people" donors.
When it comes to casting actual votes, Trump supporters are distinct from Biden voters. Trump voters are hidebound by fear, especially of the USPS. Trump voters also appear to believe a conspiracy theory that votes cast on Election Day are "more equal" than mail-in ballots or early votes before that day, and will be accorded weight and meaning that will determine the winner, while non-Election Day votes that remain uncounted that day won't be counted at all, much less determine the Will of the People.
The truth is really going to hurt Trump supporters who subscribe to that bankrupt nonsense when the election is certified by the Reality Based Community.
So, what's the "when" takeaway from broadcast debates, polling, and fund-raising ability? That when The People have access to objective unfiltered transparency, the truth will always out.

As the presidential election headed into the final stretch in late summer, counties in Ohio and Pennsylvania worried that a deluge of absentee ballot requests would swamp their printing capacity. So dozens of them contracted with Midwest Direct, a Cleveland mailing company.
But when it came time to print and ship Ohio ballots early last week, it was Midwest Direct that was overwhelmed. Several Ohio counties that expected absentee ballots printed by the company to land in voters’ mailboxes are now scrambling to print them themselves or find a last-minute contingency plan less than three weeks before Election Day.
In Pennsylvania, for instance, nearly 30,000 ballots sent to voters in Allegheny County, which includes Pittsburgh, went to the wrong addresses.
...Midwest Direct is the primary outside provider of absentee ballots for 16 Ohio counties, though many also have their own in-house operations.
Midwest Direct is owned by two brothers, Richard Gebbie, the chief executive, and James Gebbie, the chairman. This summer they began flying a Trump 2020 flag above Midwest Direct’s headquarters on the west side of Cleveland. It was a curious juxtaposition — a company in the business of distributing absentee ballots through the mail showing a preference for a president who has spent months denigrating the practice of voting by mail.
...When Midwest Direct failed to deliver promised ballots to some of its Ohio clients, Frank LaRose, the Ohio secretary of state, recommended that counties begin printing ballots in-house or “develop a contingency plan,” said Jon Keeling, Mr. LaRose’s spokesman.

Online, Mr. Gebbie has written several public Facebook posts questioning the potency of the coronavirus and he criticized Taylor Swift after she accused Mr. Trump of seeking to dismantle the Postal Service.

#130--it's funny with this Don Winslow character.....but anyway I read a couple of his crime thrillers a couple years ago--they're set on the Texas/Mexican border and are well done. It's drug cartel/DEA kind of stuff and informative fiction in a way as it jibes well with like the journalistic work of Charles Bowden for instance.

Caperton involved a litigant who spent $3 million to help elect a West Virginia Supreme Court of Appeals justice, who then voted to reverse a $50 million damage award against his benefactor. The U.S. Supreme Court found that the judge should have recused himself. Writing for the majority, Justice Anthony M. Kennedy said that recusal may be constitutionally required even where a judge is not actually biased, if there is a “serious risk of actual bias.”

They should win in Alabama but Kelley has been leading McSally for months and months now, Gardner is well behind Hickenlooper, Gideon looks like she knocks off Collins--it's looking bad for Joni Ernst and Thom Tillis and there are about 5/6 other of their seats that are very competitive like in South Carolina, the two in Georgia, even Alaska and Montana of all places and if they lose the Senate it's going to be harder for Trump to cast doubt on anything and he will be driven out and IMO it's pretty much a done deal that Romney and Murkowski would cross over and impeach him and maybe a few others like Ben Sasse and his criminal liability will rise with it. Would the cold fish McConnell even lift a finger for him? He's dead Donald walking AFAIC.

#143--If Biden wins and the Dems have both houses any deals Pence and McConnell might have made in the meantime on the courts or filibuster will be moot. It will be the Dems turn at really governing--which sometimes I'm not sure they really want to do. If Coney Barrett is approved prior to that---the filibuster protection should be killed and the Dems absolutely should pack the court. Keep in mind also that when the republicans threaten quid pro quo if and when they get power back that they've been winning power since 2000 without pluralities--by all kinds of voter suppression tactics and gerrymandering---that they absolutely depend on the electoral college (which should also be shitcanned) for the presidency, that they've been driving away black, brown, red, yellow, lbgtq people and threatening women's gender rights. What is their path back to power if they can't 'fix' things? Answer is they won't have a path. We all know white people are not going to be a majority of the population very much longer. They are a clear minority that have worked the angles for decades. Take away their angles and force them back towards the middle and some sort of reality or let them marginalize themselves further towards self destruction.

Aside from his double-digit national lead in polling, Biden's chances look good to win when we look at how Trump's approval rating remains historically low for an incumbent with hopes for a second term. Updated today, and adjusted "for each poll's quality, recency, sample size and partisan lean," 538 shows Trump enjoys less than 43% approval (and trending down) vs. 54% disapproval (trending up). He can't and hasn't cracked the 50% approval barrier that incumbents need to crack in order to feel comfortably re-electable.
Fewer and fewer Americans are registered Republicans, the demographic of the country is swinging younger, browner, more diverse, and technically oriented, with a higher percentage of highly educated women than men. Trump has lost the suburban women vote, the older vote, the college educated vote, the younger vote, the Hispanic/LatinX vote, the African American vote, and the Independents. Those losses could be the death knell of the Republican Party that existed prior to his nomination.
What will the remainders of Republicans do should he lose? Consider that the "remainers" are mostly the extremist right element, the agricultural subsidized welfare recipient farmers, and deluded "anti-communisses."
Beyond considering the political cold "civil war" that has been waged under Trump and will probably continue with his remnant enablers, consider the threat a doomed gun-loving, easily manipulated, sub-culture represents to the Common Man.
When cults and cult leaders feel persecuted and vulnerable to defeat of their ideas in -- as Plato calls it -- the marketplace, their behavior swings to increased levels of unpredictability and violence, which usually leads to mass death among the cultists as we saw in religious cults and political same in the last century.
The distinction of Trump's cult and those of the previous 100 years is an overriding sense of vindictiveness and hatred in tat tribe for anyone who opposes their cult beliefs and dares to voice or act on that opposition by demonstrating for respect for AfAm lives or wearing masks during a pandemic, or standing up for science and truth in the face of conspiracy and lies.
Cornered animals display aggressive acting out because of overwhelming fear and confusion. For more than four years, the American population has been attacked by concerted and coordinated Russian-Republican right wing extremist propaganda and agitprop to shocking effectiveness. Their time tested tactics of redefining well defined words to mean the opposite of what they do, of group-think training to elicit a Pavlovian response to dog-whistles, to increased open admission of provocative speech intended to elicit violent acting out by the newly brain-washed, to cultivating a fictitious grievance culture among white males that their woes are due to gains made by minorities and immigrants at their expense, to popularizing fictions about conspiracies against them (they're coming to take your guns), have worked exceedingly well among 40% of -- particularly -- white, poorly educated men who have clung, unchanging, to employment skills rapidly becoming extinct because they are anachronistic to the Digital Information Age. These cultists are now feeling their territory of influence and their leadership being taken away. They are feeling cornered and the potential for aggressive acting out rises as a result.
Be warned -- what you see and hear from the far right extremists is exactly what they are. Believe them when they show you. The DOJ does and has warned Trump that our most serious security threat is domestic terrorism and it isn't coming from the left. While I have donated to political campaigns for the first time in my life, I do think that the bigger dichotomy is; you think it's okay that the Democrats wasted our taxpayer dollars with an impeachment campaign that was knowingly false. But as a censorship lover, no doubt, you must not realize that the Democrats have no use for you after I am executed. Bless your heart.

Don-Boy's unpaid legal bills from his litigious gut reactions are going unpaid? Why? Because the people he's sued are refusing to pay the judgments against them. Guess who taught them that! These folks who told the truth, damn the non-disclosure agreement, aren't going to fold up and dig into their pockets to pay Trump a cent. After all, Trump is the King of Debt and hasn't paid a lot more debtors than his lawyers. And the owers have learned a lot from Professor Trump, Dean of Trump University School of Shystering.
There's unpaid city governments who were stiffed for security costs; there's caterers and event planners in lines out the West Wing, presenting rubber checks have his signature on them; there's campaign workers who took pay cuts months ago to stay in harness to re-elect him that are facing food insecurity; and there are all those unpaid taxes and loans to Russian and Ukrainian thugs that loom in his future, whether in or out of the White House.
Trump has to hone a new scam in double-quick time, or he'll be in orange-wear-daily so fast his empty head will snap on his wattle.
Then there's Ivanka's corruption charges that will have to be defended. Jared will be too busy scraping the bottom of every barrel in his backyard to stave off his own iron bar holiday to foot the bill for Daddy's little girl's future fines and legal costs.
As far as the two elder male heirs, Trump has mentally already written them off. And Rudy? Well, all he can reasonably expect as repayment for his misplaced fealty is a hearty BWAHAHAHA!

Black lives do matter; of course they do. But we know that the Black Lives Matter Movement, capital “BLM,” is political. I know this because at the height of the protest, I’ve been told of white Black Lives Matter protesters calling— and I’m afraid, I apologize for saying this word — calling a black armed police officer guarding Downing Street a “pet n*****.”
That is why we do not endorse that movement on this side of the House. It is a political movement, and what would be nice would be for members on the opposite side to condemn many of the actions that we see this political movement, instead of pretending that it is a completely wholesome anti-racist organization. There is a lot of pernicious stuff that is being pushed and we stand against that.
We do not want to see teachers teaching their white pupils about white privilege and inherited racial guilt. And let me be clear: Any school which teaches these elements of critical race theory as fact or which promotes partisan political views such as defunding the police without offering a balanced treatment of opposing views is breaking the law.
